USER AGREEMENT

1. User Registration, Collection of Personal Data, and Privacy

1.1. By placing an order on the Website www.onigiri.com.ua (hereinafter referred to as the Website), the Buyer agrees to the terms of this Agreement.

1.2. The Seller collects, stores, and processes the following personal data of the Buyer: last name, first name, email address, contact phone numbers, and mailing address. All of this information is necessary for the Seller to properly provide services and fulfill the Buyer’s orders. By placing an order on the Website, the Buyer consents to any processing of their personal data, to the storage of their personal data in the Seller’s databases, and to the transfer of their personal data to any third parties in a manner and for purposes not prohibited by the current legislation of Ukraine.

1.3. Personal information received from the Buyer is confidential. The Seller undertakes not to disclose it to third parties, except in cases where such disclosure is provided for by or not prohibited by the laws of Ukraine. The provision of information to agents and third parties acting under a contract with the Seller for the purpose of fulfilling obligations to the Buyer shall not be considered a violation. The Seller reserves the right to disclose the Buyer’s data (delivery address, last name, and phone number) to the shipping company and/or courier service that cooperates with the Seller

1.4. The Seller processes and uses the database in accordance with the provisions of the Law of Ukraine ‘On the Protection of Personal Data’.

1.5. The Buyer reserves the right to access their personal data, the right to request corrections, and the right to request that the Seller cease processing their data.

1.6. The Seller reserves the right to use the Buyer’s personal information for marketing purposes (analysis of product sales data, analysis of website traffic, email newsletters, etc.).

1.7. By registering on the Seller’s Website and providing their personal data, the Buyer agrees to provide accurate information about themselves.

2. Receipt and Processing of Customer Orders

2.1. Online purchases are made by the Buyer adding the desired product to the shopping cart on the websites www.onigiri.com.ua, as well as on the Seller’s official social media pages.

2.2. After placing an order on the Seller’s website, the Buyer receives an automatic notification at the email address provided during checkout and awaits a call from a store manager to confirm the order details.

2.3. Once the Seller has processed and confirmed the order, the parties are deemed to have entered into a sales contract with the rights and obligations provided for by the current legislation of Ukraine.

3. Delivery and Payment

3.1 Delivery is carried out using our own courier service or the companies ‘Bolt,’ ‘Uklon,’ or ‘Glovo.’ You can review the delivery terms on the website.

3.2. The Seller assumes no obligation to compensate the Buyer for any losses related to the late delivery of the order and is exempt from any possible penalties.

4. Buyer’s Inspection of the Received Order

4.1 The Buyer, upon receiving the order, must inspect it for quality and quantity.

4.2. The buyer has the right to return or exchange the goods in accordance with the provisions of Article 9 of the Law of Ukraine On the Protection of Consumer Rights.

5. Terms of the Agreement

5.1 The online store www.onigiri.com.ua reserves the right to unilaterally amend the terms of this Agreement at any time, provided that the online store undertakes to notify the Buyer of any material changes to the Agreement via email, and the Buyer agrees to receive such notifications from the online store.

5.2 The online store www.onigiri.com.ua agrees to make the terms of this Agreement freely available to the Buyer on its website.

6. Disclaimer

6.1 The online store www.onigiri.com.ua reserves the right to make changes to the goods and services provided on the website at any time without notifying the Customer.

6.2 The online store www.onigiri.com.ua shall not be liable for any damages (including emotional distress and damages resulting from loss of profits (lost profits)) arising from the use of or inability to use this website.

7. Other Terms

7.1. In accordance with Article 7 of the Law of Ukraine On Electronic Commerce, the Seller hereby informs that access to all necessary information about the Seller may be provided before, during, or after the Buyer places an order, by providing information over the phone or by any other means not prohibited by the laws of Ukraine.

* The User Agreement is understood to be a public offer agreement in accordance with the laws of Ukraine.
